Terms of Service

These Terms of Service ("Terms") govern your use of Pegasus Reply (the "Service"), operated by Max Hendricks ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. What Pegasus Reply does
Pegasus Reply connects to your business phone number and automatically texts back callers whose calls go unanswered. An AI assistant, configured with information you provide about your business, can then continue that conversation by text — answering questions, logging booking requests, and escalating to you when it isn't sure how to help.
2. Your account and subscription
- You must provide accurate information when setting up your account and business profile.
- New accounts get a 14-day free trial. After the trial, continued use requires an active paid subscription, billed monthly via Stripe.
- You can cancel or manage your subscription at any time through the billing management portal in your dashboard.
- If payment fails or your subscription lapses, we may pause the automated texting/AI features on your account until it's resolved.
3. Your responsibilities
You are responsible for how you use the Service to communicate with your own customers, including:
- Having a lawful basis to text people who call your business number (for most missed-call-follow-up use cases, replying to someone who just tried to contact you is standard practice, but you remain responsible for complying with applicable telecoms and marketing communication laws).
- Only providing accurate information in your business profile, hours, and FAQ.
- Reviewing escalated conversations promptly — the Service flags conversations it can't confidently handle, but a human (you) needs to follow up.
- Not using the Service for spam, harassment, or unlawful communications.
4. AI-generated responses
Replies to your customers are generated by an AI model based on the information you provide. While we design the system to escalate uncertain situations to you rather than guess, AI-generated text can occasionally be inaccurate or miss context. We recommend reviewing your business information periodically for accuracy and checking in on conversations, especially early on.
5. Service availability
We aim to keep the Service reliable, but it depends on third-party infrastructure (including telecoms carriers and AI providers) that is outside our control. We don't guarantee uninterrupted availability and aren't liable for missed messages or calls caused by third-party outages.
6. Limitation of liability
The Service is provided "as is." To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential losses (including lost business or lost customers) arising from your use of the Service. Nothing in these Terms limits liability that cannot be excluded under applicable law.
7. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate accounts that violate these Terms or are used unlawfully.
8. Changes to these Terms
We may update these Terms from time to time. We'll make reasonable efforts to notify active account holders of material changes.
9. Governing law
These Terms are governed by the laws of England and Wales.
